Purchase Terms and Conditions
I. Purchase Terms and Conditions
These Terms and Conditions of Sale (hereinafter referred to as the “Terms”), once accepted by the Buyer (after having read the Terms and ticking the box next to the statement “I have read and agree to the Elia’s HOME Terms and Conditions”), constitute a legally binding document between the parties. They set out the rights and obligations of the Buyer and the Seller, Edita Liaugaudienė, Individual Activity Certificate No. 993723, who sells goods through the online store www.eliashome.eu, as well as the terms and conditions for purchasing and paying for goods, the procedures for delivery and returns, the liability of the parties, and other provisions relating to the purchase and sale of goods through the Elia’s HOME online store.
The Seller reserves the right to amend, revise, or supplement these Terms at any time, in accordance with the requirements of applicable laws and regulations.
The following persons are entitled to make purchases from our on-line store:
natural persons with full legal capacity, i.e. persons who have reached the age of majority and whose legal capacity has not been restricted by a court;
minors between the ages of fourteen and eighteen, provided they have the consent of their parents or legal guardians, except in cases where they are legally entitled to independently dispose of their own income;
legal entities;
duly authorized representatives of any of the above-mentioned persons.
By accepting these Terms, the Buyer confirms that, in accordance with Clause 3 of this Section, they are entitled to purchase goods from the Elia’s HOME on-line store.
II. Personal Data Protection
When placing an order, the Buyer must provide, in the relevant fields provided by the Seller, the personal data necessary for the proper processing and fulfilment of the order: first name, surname, delivery address, telephone number, and email address.
By accepting these Terms, the Buyer agrees that the personal data specified in Clause 1 of this Section may be processed for the purposes of the sale of goods and services through the Elia’s HOME online store, direct marketing, and the proper operation and administration of e-commerce activities.
By consenting to the processing of their personal data for the purpose of purchasing goods and services through the Seller’s on-line store, the Buyer also agrees to receive informational communications necessary for the processing and fulfilment of their order via the email address and telephone number provided by the Buyer.
A Buyer who does not wish their email address and/or telephone number to be used for direct marketing purposes must inform the Seller by sending a notification to eliashomeinfo@gmail.com.
The Seller confirms that the personal data provided by the Buyer will be processed solely for the purposes of selling goods and services through the Elia’s HOME on-line store, conducting the Seller’s direct marketing activities, and ensuring the proper operation of e-commerce activities. The Seller undertakes not to disclose the Buyer’s personal data to third parties, except for the Seller’s partners providing delivery services or other services necessary for the proper processing and fulfilment of the Buyer’s order. In all other cases, the Buyer’s personal data may be disclosed to third parties only in accordance with the procedure and circumstances provided for by the applicable laws of the Republic of Lithuania.
In accordance with Clause 2 of Section IX of these Terms, any identity document presented by the Buyer to the Seller’s representative or an employee of Lietuvos paštas (Lithuanian Post), as well as the personal data contained therein, shall be used solely for the purpose of verifying the Buyer’s identity.
III.Conclusion of the Purchase and Sale Agreement
The agreement between the Buyer and the Seller shall be deemed concluded from the moment the Buyer has selected the item(s) they wish to purchase, added them to the shopping cart, and clicks the “Pay” button.
Each purchase and sale agreement concluded between the Buyer and the Seller is recorded and stored in the Elia’s HOME online store database.
IV.Buyer’s Rights
The Buyer has the right to purchase goods from the Elia’s HOME on-line store in accordance with these Terms and the procedures set out in other relevant sections of the Seller’s on-line store.
In accordance with the provisions of the laws of the Republic of Lithuania governing the legal relationship between the Seller and the Buyer, the Buyer has the right to withdraw from a purchase and sale agreement concluded through the Elia’s HOME online store by notifying the Seller in writing (by email, specifying the item they wish to return and the relevant order number) no later than within 7 (seven) business days from the date of delivery of the goods.
The Buyer may exercise the right provided for in Clause 2 of this Section only if the goods have not been damaged or used and their appearance has not been materially altered.
V. Buyer’s Obligations
The Buyer is obliged to pay for and accept the goods in accordance with the procedures set out in these Terms.
If any of the information provided by a registered Buyer in the registration form changes, the Buyer must update such information without undue delay.
By using the Elia’s HOME online store, the Buyer undertakes to comply with these Terms, any other terms and conditions clearly specified in the online store, and the applicable laws and regulations of the Republic of Lithuania.
VI.Seller’s Rights
If the Buyer attempts to compromise the stability or security of the on-line store or fails to fulfil their obligations, the Seller has the right to immediately and without prior notice restrict or suspend the Buyer’s access to the on-line store or, in exceptional circumstances, cancel the Buyer’s registration.
Where significant circumstances arise, the Seller may temporarily suspend or permanently discontinue the operation of the on-line store without prior notice to the Buyer.
The Seller has the right to cancel the Buyer’s order without prior notice if the Buyer fails to pay for the goods within 14 (fourteen) business days.
VII.
Seller’s Obligations
The Seller undertakes to provide the Buyer with access to and the ability to use the services offered by the Elia’s HOME online store in accordance with the terms and conditions set out in these Terms and on the online store.
The Seller undertakes to respect the Buyer’s right to privacy with regard to their personal information and to process the personal data provided by the Buyer solely in accordance with Section II of these Terms and the applicable laws and regulations of the Republic of Lithuania.
The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer in accordance with the terms and conditions set out in Section IX of these Terms.
If, due to significant circumstances, the Seller is unable to deliver the goods ordered by the Buyer, the Seller undertakes to offer an equivalent product or a product with characteristics as similar as reasonably possible. If the Buyer refuses to accept an equivalent or similar product, the Seller undertakes to refund the amount paid by the Buyer within 3 (three) business days, provided that advance payment has been made.
Where the Buyer exercises the right provided for in Clause 2 of Section IV of these Terms and the condition set out in Clause 3 of Section IX of these Terms is met, the Seller undertakes to refund the amount paid by the Buyer within 10 (ten) business days from the date on which the returned goods are received.
VIII. Prices, Payment Methods and Payment Terms
The prices of goods displayed in the online store and in the completed order are stated in euros (EUR) and include VAT.
The Buyer may pay for the goods using the following payment method: payment by credit or debit card.
The order will only be processed, and the delivery period will only begin to run, once payment for the goods has been received.
IX. Delivery of Goods
When placing an order, the Buyer may choose one of the delivery methods available in the online store.
Delivery of Goods to the Buyer
When selecting a delivery service at the time of placing an order, the Buyer undertakes to provide the exact delivery address.
The Buyer undertakes to accept the goods personally. If the Buyer is unable to accept the goods personally and the goods are delivered to the address specified by the Buyer based on the information provided by the Buyer, the Buyer shall not be entitled to make any claims against the Seller regarding the delivery of the goods to an unauthorised person. When collecting the goods, the recipient must have a valid identity document (identity card, passport, or valid driving licence) and present it to the authorised representative upon request.
The goods shall be delivered by the Seller or the Seller’s authorised representative.
The Seller shall deliver the goods to the Buyer within the delivery times specified in the relevant product descriptions. These delivery times are indicative and shall not apply where the required goods are unavailable in the Seller’s warehouse, in which case the Buyer shall be informed of the unavailability of the goods ordered. The Buyer acknowledges that, in exceptional circumstances, delivery may be delayed due to unforeseen circumstances beyond the Seller’s reasonable control. In such cases, the Seller undertakes to contact the Buyer without undue delay and agree on revised delivery arrangements.
The Seller shall not be held liable for failure to meet the stated delivery times where the goods are not delivered or are delivered late due to the Buyer’s fault or circumstances attributable to the Buyer.
Upon delivery of the goods, the Buyer must, together with the Seller or the Seller’s authorised representative, inspect the condition of the parcel and the goods and sign the delivery and acceptance document. Once the Buyer has signed the delivery and acceptance document, the parcel shall be deemed to have been delivered in good condition, with no visible damage to the goods other than manufacturing defects and no discrepancies in the contents or completeness of the order that could have been identified through an external inspection of the goods.
If the Buyer notices that the packaging of the delivered parcel is damaged (crushed, wet, torn, or otherwise externally damaged), that the goods are damaged and/or that the contents of the delivery are incomplete or incorrect, the Buyer must record this on the delivery and acceptance document and, in the presence of the Seller or the Seller’s authorised representative, prepare a written report in free form describing the damage to and/or discrepancies in the parcel or goods.
If the Buyer fails to take these steps, the Seller shall not be held liable for damage to the goods where such damage is not attributable to a manufacturing defect, or for discrepancies in the contents or completeness of the order where such discrepancies could have been identified through an external inspection of the goods.
X.
Quality of Goods
The general characteristics and specifications of each product sold by Elia’s HOME are provided in the relevant product description available alongside each product in the online store.
The Seller shall not be held liable for any differences between the appearance of the products displayed in the online store and the actual products, including differences in colour, shape, size, or other characteristics, where such differences result from the settings or technical characteristics of the Buyer’s device or display.
XI. Returns and Exchanges
Any defects in goods sold, as well as the replacement or return of defective goods, shall be handled in accordance with the applicable laws and regulations of the Republic of Lithuania.
The Buyer may return goods within 14 (fourteen) business days from the date of delivery by notifying the Seller in accordance with the procedure set out in Clause 2 of Section IV of these Terms.
When returning goods, the Buyer must comply with the following conditions:
the returned goods must be in their original and undamaged packaging (this requirement does not apply to defective goods);
the goods must not have been damaged by the Buyer;
the goods must be unused and must retain their original saleable condition, including intact labels, protective films, and other relevant packaging or protective elements (this requirement does not apply to defective goods);
the returned goods must include all components and accessories supplied to the Buyer at the time of delivery;
proof of purchase must be provided when returning the goods.
The Seller has the right to refuse to accept returned goods if the Buyer fails to comply with the return procedure and requirements set out in this Section of the Terms.
Any refund for returned goods shall be made by bank transfer exclusively to the bank account of the person who made the original payment.
XII. Liability
The Buyer is fully responsible for the accuracy and correctness of the personal data provided by them. If the Buyer provides inaccurate or incorrect personal data, the Seller shall not be held liable for any consequences arising therefrom and shall have the right to claim compensation from the Buyer for any direct losses incurred as a result.
The Buyer shall be responsible for all actions carried out while using the online store.
A registered Buyer is responsible for maintaining the confidentiality of their login credentials and for any disclosure of such credentials to third parties. If a third party accesses and uses the services provided by Elia’s HOME by logging into the online store using the Buyer’s login credentials, the Seller shall consider such person to be the Buyer.
The Seller shall not be held liable for any losses arising from the Buyer’s failure to read and familiarise themselves with these Terms, despite having been provided with a reasonable opportunity to do so and notwithstanding the Seller’s recommendations and the Buyer’s obligations.
In the event of loss or damage, the party responsible shall compensate the other party for any direct losses incurred.
XIII. Final Provisions
These Terms have been drawn up in accordance with the laws and regulations of the Republic of Lithuania.
Any legal relationship arising under or in connection with these Terms shall be governed by the laws of the Republic of Lithuania.
Any disagreements or disputes arising from or in connection with the implementation of these Terms shall, in the first instance, be resolved through mutual negotiations between the parties. If the parties are unable to reach an agreement, the dispute shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
